Sahuarita Municipal Court

The following cases were heard on Nov. 4 unless otherwise indicated. Information on these cases was provided by the Sahuarita Town Prosecutor’s office.

Ryan Alton Storm, 28, Tucson, showed he had done considerable anger management counseling and won a withdrawal of a petition to revoke his probation on charges of domestic violence. He was set up with a $50 a month payment plan toward his balance owed of $2,810.

Marco A. Collao, 44, Sahuarita, won dismissal of charges of failure to appear and carrying a concealed deadly weapon after he showed he had completed a weapons safety class, as is required for a permit to carry a concealed weapon.

Luis Armando Somoza, 32, Tucson, will do defensive driving school on a speeding charge and took the standard plea bargain on a charge of driving on a suspended license, meaning he pleaded conditionally guilty and must show a valid license in court in order to get a reduced fine. He did the same for a charge of driving with an expired registration. He must show a valid registration in court in order to win a reduced fine on that charge.

Tangye Lee Slate, 33, Arivaca, pleaded guilty to reckless driving and won dismissal of the original charges of drunken driving, speeding and failure to obey a traffic control device. She must go to jail for one day; pay a fine of $500 plus fees for a total of $736; complete a Mothers Against Drunk Driving victim impact panel; undergo an alcohol evaluation and take any treatment recommended and was placed on 12 months probation.

Kristen Lee Haun, 38, Sahuarita, who was in custody, pleaded guilty to false reporting to police and driving on a suspended license and won dismissal of another charge. She was fined $830, increasing her total owed to $2,445, which included fines for underlying charges of driving without insurance and with expired registration. She was set up with a payment plan of $25 a month, or 97 months, assuming she does not make early or extra payments.


Abel Tanori, 28, Sahuarita, took the standard plea bargain on a charge of driving on a suspended license, which means he could reduce his fine from $565 to $143 for the lesser charge of driving with no license in his possession.

Guadalupe Patla Moreno, 37, Sahuarita, had her theft case transferred to Green Valley Justice Court Judge Maria Avilez, who said she was concerned that she would have a conflict of interest. Aviliez said she believed the defendant’s husband was the son of Town Council Member Marty Moreno, who was part of the council that approved Avilez’ contract extension. The case was set for 8 a.m. on Nov. 21 in Justice Court. A domestic violence charge was dismissed at the request of the victim.

David Martin Bustamante-Banuelos, 19, Amado, who was in custody on a charge of possession of drug paraphernalia, was sentenced to 16 hours drug education and was fined $262, bringing his total owed to $1,990, and was placed on 12 months probation. He originally was charged with driving on a suspended license and a civil traffic violation and had been offered diversion, but never completed diversion and was found guilty in absentia on Sept. 22, when an arrest warrant was issued for his arrest.

On Nov. 6, Elizabeth Holt, 26, Sahuarita, was found not guilty in a bench trial on an animal control charge.

Arrests and Citations

Pablo J. Giovannari, 49, Tucson, on Nov. 2 at 8:30 p.m. at the One-Stop store, 16100 S. Nogales Highway, was cited for criminal nuisance and having an open container of alcohol in a motor vehicle. Police were called by a motorist on Interstate 19 who said a driver in front of him was swerving from lane to lane. The caller followed the swerving driver off the highway and onto Sahuarita Road, then said he saw the driver get out behind the One-Stop, get out of his truck and urinate on the side of the building. The motorist tried to detain the driver and apparently threw him to the ground, holding him until police arrived. Police said Giovannari appeared drunk, with bloodshot eyes and a smell of alcohol about him and police separated the two men. Giovannari was asked what was taking place and said “call Willy,” said he was going to a race, then called out “Obama, Obama.” After police handcuffed Giovannari and informed him of his right to remain silent, he said to an officer “I have your wife’s telephone number,” then did not speak further. Police saw a bottle of vodka in his truck, cited him and called his wife, who came and took him home.

Juan Carlos Martinez, 23, Amado, on Oct. 28 at 6:30 p.m. at Wal-Mart, was charged with shoplifting, after he allegedly put on a belt from the store, paid for another item and left the store without paying for the belt or a package of sports wrap that was found on his person. He told police a friend said it was easy to steal things from Wal-Mart.

Lynette Geraldine Reynard, 67, Green Valley, on Oct. 28 at 2:30 p.m. in a pecan grove near the 21000 block of South Nogales Hwy. was charged with drunken driving and failure to control her speed to avoid an accident after her car apparently hit a tree in a pecan grove about 100 yards west of the roadway. She told police she had been driving, became dizzy, tried to turn around and blacked out, and didn’t know how long she had been there. She said she had taken a muscle relaxant and the pain-killer Vicodin two hours earlier. Paramedics took her to University Medical Center in Tucson and a blood sample was taken.

Manuel Rene Hernandez-Navarro, 28, Sahuarita, on Oct. 29 at 7:30 a.m. at Rancho Sahuarita Boulevard and Calle Vista Arga was charged with driving on a suspended license, suspended registration, having no license in his possession and no insurance.

Nathan Andrew Dixon, 21, Tucson, on Oct. 27 at 1:20 a.m. on Nogales Hwy. at mile marker 50 was charged with driving on a suspended license. He had been stopped for suspicious driving behavior.

Warrants

Jaime Ernesto Lucero, 19, Nogales, criminal speeding.

Sammy Dale Morgan, 23, Green Valley, failure to appear.

Xavier Jesus Mendez, 23, Sahuarita, failure to appear.

Alfredo Benitez, 42, Tucson, driving on a suspended license.
