Sahuarita Municipal Court

Jose Armando Flores, 39, Sahuarita, an off-duty Tucson police officer, was found not guilty of disorderly conduct charges following a trial on Aug. 14 and 15, basically because Magistrate Maria Avilez did not find the victim’s testimony credible enough to warrant a conviction. Flores was driving home from work on Oct. 13, 2007, and got into an altercation with another motorist on Rancho Sahuarita Boulevard. He was accused of yelling at the motorist and putting his hand on his service revolver. Defense lawyer David Quantz said that the victim’s account differed each time he told it, but Town Prosecutor Chris Wencker said that while the wording was different, the essential story was the same. Quantz also said that Flores was responding as any trained police officer would in that situation. Several Tucson police officers came to court prepared to act as expert witnesses, but were not permitted to testify.

Steven Paul Chacon, 32, Tucson, won a dismissal of charges of failure to appear and owes fines and fees of $123 on speeding. He showed proof that the license suspension was a mistake by the court in Benson.

Bernard David Powell, 58, Green Valley, pleaded guilty to criminal speeding and was given fines and fees of $299. He was clocked at 37 miles per hour in a 15 mph school zone on La Canada Drive. The judge asked if a diversion were possible, but the prosecutor said he would not support that because the infraction was in a school zone.

Derrick Ray Harris, 37, Sahuarita, won dismissal of charges of no dog license after he showed he had obtained a valid license. On a leash law violation, a civil charge, he will go to animal care class at the Humane Society, which could result a dismissal of that charge.

Jeffrey Jorgenson, 23, Sahuarita, who was in custody, was found in violation of probation for failing to enroll in supervised probation and was ordered to start 12 months probation again on Aug. 12, supervised by Southwest Intervention Services. He pleaded guilty to failure to appear and was sentenced to time served, to anger management and alcohol evaluation and any treatment recommended. He was found in contempt of court for failing to do domestic violence counseling and a $268 fine that had been suspended was imposed. He was ordered held on a $200 bond until he provides the court with a physical address.


Paul John Miller, 44, Sahuarita, won dismissal of a domestic violence charge and must comply with the court’s terms after pleading guilty on another domestic violence charge.

Keith R. Miller, 42, Green Valley, pleaded responsible to speeding and was fined $202. Other charges were dismissed.

Jeffrey Alan Kemmer, 42, Green Valley, won dismissal of a suspended license charge and owes $90 for speeding.

Miguel Angel Madrid, 30, Tucson, pleaded guilty to failure to appear and his fine was suspended pending payment of his balance owed of $1,326. He was given a payment plan of $100 a month and must take a drug education class and return to court on Sept. 9 on a petition to revoke his probation.

Erik Michael Pearce, 24, Sahuarita, pleaded conditionally guilty to possession of marijuana and drug paraphernalia and was given suspended fines of $1,658, a prosecution fee of $75 and drug education classes.

Gerald Manuel Havey, 23, Tucson, pleaded guilty to criminal speeding for doing 64 miles per hour in a 35 MPH zone on Sahuarita Road in front of the high school at 11 p.m. and was fined $299. An insurance charge was dismissed.

Pamela Jean Martinez, 43, Tucson, plead conditionally guilty to a charge of possession of drug paraphernalia and was given 16 hours of drug education, a $75 fee and a $268 suspended fine. She had been found asleep in her vehicle at the One-Stop parking lot and allowed a police search of her vehicle, which turned up a can with cocaine residue.

Gildardo Ortiz, 34, Tucson, was given defensive driving school on a speeding charge and pleaded conditionally guilty to driving on a suspended license.

Adriana Fregoso, 29, Sahuarita, won dismissal of an animal control charge and is in the process of converting a $40 bond to pay the fee for a warrant issued when she skipped her arraignment.

Marianne C. Rowley, 83, Green Valley, pleaded guilty to an amended charge of speeding in a school zone and was fined $411, including the basic $270 fine plus a $141 surcharge.

Jarred Shane Archulet, 21, Vail, pleaded guilty to failure to appear and was given a fine of $268 that was suspended pending his payment of the $2,400 he owes on other charges.

Francis P. McAleer, 66, Sahuarita, pleaded guilty to driving with an open container and criminal damage, and was given $699 in fines, fees and restitution, including $100 for hitting a street sign.

Jesse Daniel Dobos, 26, Sahuarita, pleaded guilty to failure to appear and was given a fine of $257 that was suspended pending payment of more than $800 he owes on other charges. He agreed to do a drug evaluation and any recommended treatment and won withdrawal of a petition to revoke his probation.

Marina E. Amans, 23, Tucson, who was a cashier at Bealls and was convicted of shoplifting, asked the court to set aside the conviction because she wanted to go to nursing school and the conviction was preventing her from getting a job as nurse. She originally had been offered diversion but never completed her civic responsibility class and was convicted, so came to court and showed she had completed that and showed proof of enrollment in nursing school, so the judge granted her application, set aside the conviction and dismissed the case.

Leesa Ann Raber, 46, Sahuarita, pleaded guilty or responsible to driving on a suspended license and other charges and was fined $2,022. She told the court her license had been suspended for some time, that she did not expect she would be able to get her license reinstated for some time and that she had only been driving to the grocery store the day she was cited to get food for herself and her children.

Jon William Jones, 19, Green Valley, pleaded guilty to reckless driving after drunken driving and other charges were dismissed. He was fined $540, ordered to provide fingerprints, to undergo an alcohol evaluation and any recommended treatment and was placed on 12 months probation. His mother was in court and said she would pay the fine.

Christopher J. Lucro, 29, Tucson, pleaded guilty to failure to appear and was given a fine of $257 that was suspended pending his payment of a balance of $1,362.

Michael Lee Baker, 43, Sahuarita, won dismissal of all charges after he showed he had completed counseling to resolve a conditional guilty plea to domestic violence and other charges.

Arrests and Citations

Mary Ellen Lucas, 45, Sahuarita, on July 29 at 5:40 a.m. was charged with leash law and biting animal violations. Her mastiff Buster allegedly got loose and went to bite a man on a bicycle, causing him to fall and break his collarbone.

Gloria Maria Lopez, 21, Sahuarita, on Aug. 2 at 1:35 p.m. was cited for domestic violence for allegedly using a rock to break the window of a car owned by her ex-boyfriend. She told police she had helped pay for the car, but he was signing it over to his mother.

James Joseph Ryba, 18, Vail, was cited for shoplifting at Wal-Mart, where he had been an employee, on several dates on July and August. He was accused of taking $350 from the cash register in total.

Sergio Anthony Schach, 19, Amado, on Aug. 8 at 10:17 p.m. near La Villita and El Toro roads was charged with expired registration, no license in his possession and possession of drug paraphernalia.
